Members are reminded of their responsibility to declare any Disclosable Pecuniary Interest or Other Disclosable Interest which they have in any item of business on the agenda, no later than when that item is reached or as soon as the interest becomes apparent and, with Disclosable Pecuniary interests, to leave the meeting during any discussion or voting on the item.

In this case the Board has a discretion to exclude the press and public and, in view of the nature of the business to be transacted, it is RECOMMENDED that under Section 100A(4) of the Local Government Act 1972, having been satisfied that in all the circumstances of the case the public interest in maintaining the exemption outweighs the public interest in disclosing the information, the press and public be excluded from the meeting for the following item(s) of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12A to the Act.

The Council wishes to maintain its commercial property transactions and information relating to disposal prices of property assets confidential so that it does not prejudice its other property dealings and protect the Council’s commercial confidentiality.

Account has been taken of the advantages of disclosure in terms of transparency and accountability.  However, consideration has also been given to the damage to the public interest in disclosing the contract value and associated bed rate, given the community interest in this by other care home bed providers in the Borough. Therefore, on balance, the advantage of confidentiality outweigh the advantages of disclosure.

The public may be interested in fee uplifts for the care sector and the impact on the social care budget.  The disclosure of the negotiations, consultation and fee structure may jeopardise negotiations and drive up costs.

Notice is hereby given that under Regulation 5 of the above, Councillor Gilligan, as Chair of the Corporate Policy and Performance Board, has agreed to the following item of business being considered in Part II, as the item of business is considered urgent and cannot reasonably be deferred for the reason stated below:

The present contract extension is expiring and there is a need for continuity of service.
