Decision Maker: Chief Executive

Decision status: Recommendations Approved

Is Key decision?: No

Is subject to call in?: No

Decision:

There is reasonable cause to revoke the licence and it appears that the interests of public safety require the revocation of the licence to have immediate effect.

Reasons for the decision:

1.Take no action and allow the external investigation to take its course.

2.Revoke the driver’s licence in accordance with S61(1)(b) of The Local Government (Miscellaneous Provisions) Act 1976 only. This would take effect after 21 days has elapsed (providing there is no appeal the decision to the Magistrates Court).

These were rejected on the grounds of the risk to public safety.

Alternative options considered:

1.Take no action and allow the external investigation to take its course.

2.Revoke the driver’s licence in accordance with S61(1)(b) of The Local Government (Miscellaneous Provisions) Act 1976 only. This would take effect after 21 days has elapsed (providing there is no appeal the decision to the Magistrates Court).

These were rejected on the grounds of the risk to public safety.
